LEGAL RULES OF THE COMPETITION ""Victoria Square 10th Anniversary Competition""

The start date will be 3rd March 2018 at 10am and will close at 6pm on 4th March 2018. Prizes will be awarded every hour, with the list of entrants drawn from all check ins made to the Remus Uomo Victoria Square Facebook Location in the previous hour. Winners should be notified within half an hour and the first draw will take place after 11am on Saturday 3rd March for all entrants made from 10am-11am

Organizing company
Douglas and Grahame, parent company of Italian Apparel, the operators of Remus Uomo, Victoria Square is organising a CONTEST called “Victoria Square 10th Anniversary Competition”, via data collected when users "check in" to the Remus Uomo Victoria Square Facebook Location or which is given to them in store when a public check in is not possible. This competition is valid only in the United Kingdom and Ireland. The winners will be privately notified but an anonymised version of this information can be shared on request.

The mere fact of participation implies knowledge and acceptance, with no reserves or conditions, of the present rules. The participant should read and accept these rules before participating in this contest.

The contest is open to the United Kingdom and Ireland only and the participation is free of charge to all the participants (no purchase or payment of any kind is necessary to enter or win). In case of mistake or conflict, any decision taken by Douglas & Gahame will be unappeallable.

 

Contest procedure:

To be eligible to participate in the contest, competitors must:

- Be an individual at least 16 years of age

- Have a functioning Facebook account

- Visit Remus Uomo Victoria Square, Belfast

- Have an active mobile phone

- Open Facebook on their mobile device and check in to the store location on Facebook

To enter through Facebook the privacy setting on your check in post must be set to "public." If you do not wish to post publicly you can check in, show your check in post on your device to our staff in store who will record your name and mobile telephone number and the time you entered. This information will be securely destroyed at the end of the promotion and no record of entrants other than the winner will be kept. 

Each person can participate as many times as they like over the course of the weekend but can only win a prize once during the course of the promotion. To enter more than once without a publically viewable check in on Facebook, you must be present in store and give your contact details to a member of staff. 

Employees of the organizing company are excluded from this contest and thus cannot participate in it.

Douglas & Grahame Ltd or its subsidiary companies won’t accept comments or messages which are against the law, racist, religious, political, with pornographic content or advocating terrorism.

 

Prizes


Facebook usernames of each entrant will be recorded after each hourly deadline on an Excel spreadsheet that will automatically number all participants, alongside the names and contact telephone numbers of any in store entrants who cannot publicly post their check in. 

Via a random number generator, a winning number and two runners-up will be generated.

Then the profile of the winner number will be manually checked to ensure that it meets the participation requirements set out in these rules. If not, runners-up 1 and 2 will then be checked successively. If none of them comply with the requirements, another three random numbers will be generated, so that the prize does not end up being declared void.

If the winner’s privacy setting thus permits, he or she will receive notification of winning the prize and the instructions for receiving it, via a private message or comment on their check in. Or if an in store entry was received, a call direct to their mobile from a member of the store team. A response is required within 7 days of notification. 

If the winner cannot be contacted within the 7 calendar days from the first contact attempt, or waives the prize, the winner will lose his or her right to claim the prize. The fact that the winner does not contact Douglas & Grahame Ltd within this period will entail renouncing the prize, while all the transferable rights inherent to holding the winning title will be expressly assigned perpetually to Douglas & Grahame Ltd although the participant shall not be able to claim for any right, compensation or indemnity of any type from Douglas & Grahame Ltd. 

The prize will consist of a £50 voucher to spend in store at Remus Uomo Victoria Square. One prize will be awarded per winner. The prize will not be broken down. 13 prizes will be given over the course of the weekend. The first prize on Saturday will be allocated at 11am, with the last prize being allocated at 6pm on Saturday. The first prize on Sunday will be awarded at 2pm and the last prize awarded at 6pm. Winners can call in store immediately if the store is open or at anytime in the coming month to pick up their prize. 

After a full calendar month has passed and the voucher remains unclaimed this will entail renouncing the prize, while all the transferable rights inherent to holding the winning title will be expressly assigned perpetually to Douglas & Grahame Ltd although the participant shall not be able to claim for any right, compensation or indemnity of any type from Douglas & Grahame Ltd.

Provisos and limitations


The contest is open and public, with no discrimination for gender or nationality. Douglas & Grahame Ltd and its subsidiaries advocate equal opportunities and strict respect for good faith standards. For this reason, any abusive or fraudulent use of these rules will give rise to the participant’s consequent disqualification from the contest, Douglas & Grahame Ltd not being held liable, and without the disqualified person having any right to claim for compensation.

 

The organizing company reserves the right to disqualify any user or participant from the contest who defrauds, alters or hinders the smooth running and normal and regulatory course of the contest rules. The definition of causing fraud consists of, but is not limited to, detecting the use of applications outside the website; conducting abuse of queries to the server and all conducts that could be abusive and/or malicious.

 

Verification of any of these circumstances during the Contest will lead to the participant's automatic disqualification from the Contest, and the loss of the prize, if he or she had won it. Douglas & Grahame Ltd reserves the right to block and/or denounce users it suspects may be fraudulent or false. Douglas & Grahame Ltd reserves the right to take legal action against those persons who take any type of action liable to be considered manipulation or falsification of the promotion.

 

Douglas & Grahame Ltd is released from any responsibility in any of these cases:

(i) error in the data provided by the competitor awarded that prevents his or her identification or communications with this party 

(ii) the users personal settings prevent identification, notification or communication with this party

(iii) temporary lack of availability or continuity in operating the services via which it participates in the contest, defrauding the usefulness that users could have attributed to them and, in particular, although not exclusively, access failures to the different pages and mailings of participation responses via the internet, or telephone communications enabled to this end

(iv) delays, losses or damages for causes not attributable to it

(v) cases of force majeure

 

The organizing company is exempt from all responsibility if any of the cases above should take place, as well as any responsibility for damages and losses that could occur while enjoying the prize.

 

Douglas & Grahame Ltd reserves the right to make changes that have an impact on the successful completion of the contest when there are just causes or force majeure that prevent it from being carried out in the manner set out in these legal rules.

Douglas & Grahame Ltd reserves the right to defer or extend the Contest period, and the power to interpret the present legal rules.

 

The organizing company reserves the right to shorten, extend, modify or cancel this promotion if exceptional circumstances take place that prevent it from being carried out, reporting these circumstances so that any damages to Contest participants are prevented.

Data protection

The digital data provided by participants will be handled confidentially and compiled in an automated file with personal data, where Douglas & Grahame Ltd is the owner and responsible for this file for the purpose of managing and promoting the present contest. The written data provided by participants will be handled confidentially and compiled in hard copy for the purpose of managing the present contest.

Douglas & Grahame Ltd reserves the right to use the winner's social media data for the purpose of administrating this competition.

Participants who have supplied their personal data, may contact Douglas & Grahame Ltd in its capacity as the owner of the file, in order to freely exercise their rights of access, rectification, cancellation, opposition or any other rights developed by the future Regulation (EU) 2016/679.

Any data gathered for the purposes of administrating the competition will not be used for ongoing marketing purposes or shared with any third party entities. Any original digital data will be held on a secure private server in concordance with existing data protection laws.

 

Acceptance of the rules

The mere fact of participation implies knowledge and acceptance, with no reserves or condition, of the present rules, due to which any statement of totally or partially not accepting them will lead to the participant’s exclusion and, consequently, Douglas & Grahame Ltd, Italian Apparel and Remus Uomo shall be released from compliance with the obligation taken on with the participant in question.

 

Competent jurisdiction

Any questions that could arise from the interpretation of the present document, the parties shall submit to the jurisdiction of the Courts, expressly renouncing any other jurisdiction that could be applicable to them.

 

The contest and the prizes are ruled by the current tax legislation.
